What is Service of Process?

Service of Process is when legal documents such as summonses, complaints, subpoenas, writs and other court documents are delivered to the individual to whom the legal document is directed.

Service of Process must be done by an individual who is not a party to the case

What does a Process Server do?
Ace Inquiry Agents delivers (or serves) legal documents to a defendant or an individual involved in a court case. The process server must serve the documents in accordance with the legislation in the area of service. Once the documents are delivered, the process serving agent must provide proof that the papers were served. This is done through a document called an Affidavit of Service, which must be notarized and given to the party who requested service.

Ace Inquiry Agents can also file your documents with the courts, can do document retrieval and offer various types of investigations: skip trace, debtor location, surveillance, tracking, etc.

Do I need a Process Server?
Hiring a legal process server is an important step in proceeding with a court case. In some states, someone who performs service of process is required by law to be licensed, so if you are in one of these states, the answer is "Yes!”
Hiring a legal process server is an important step in proceeding with a court case.

Ace Inquiry Agents have the skills and experience to serve your legal documents in a timely and affordable manner and, more importantly, serve them in accordance with the local and state process serving rules.
Even if a process server does not need to be licensed in the state where you need service, you should keep in mind that a process server is someone who is experienced in serving legal documents efficiently. More importantly, Ace Inquiry Agents are knowledgeable of the legislation surrounding service of process in Australia and Oceania.

There are several requirements and constraints associated with serving legal documents that vary from state to state, and country to country. If a serve is not done in accordance with these rules, this can hinder your case from going forward or result in the dismissal of your case. Improper service can also delay obtainment of evidence, which can cause injunctions, court fees, and lawyer’s fees.

How much does it cost to get documents served?
Process serving rates can vary from case to case, state to state, and depend upon your requirements.

Ace Inquiry Agents offer…
Same day serve - a serve that is first attempted the same day as receiving the documents, provided they are received by 10AM Australian western standard time (Perth)
Rush serve - a serve that is first attempted within 1-4 days of receiving the documents.
Routine serve - a serve that is first attempted within 5-7 days of receiving the documents.
Super serve - employs extensive advance preparation to serve elusive or aggressive subjects, yielding successful results in case after case.

When choosing a service, consider…

Last date for service – How much time there is to serve documents will depend upon when your court case is listed for hearing.

Number of attempts required – dependant upon whether the defendant’s address is current, whether they are trying to avoid service, or simply not present at the time.
